Terms of Use
1. Purpose. Bright Sky House LLC (“BSH”) believes that storytelling is a powerful tool for creating awareness and inspiring action. Through our storytelling, Users will have an opportunity to explore and investigate topics that we have encountered first-hand as crime scene cleaners including hoarding, suicide, drug use, interaction with law enforcement, and so much more. By bringing these stories to light, we aim to inform, educate, and provide hope to those who may one day face similar challenges.
2. Legal Agreement (“Agreement”).
a. Agreement. By merely using services of, obtaining information from, or initiating applications within this website, you, the User (“User” or “You”) agreed to be bound by BSH’s Terms of Use (“Terms of Use”). User further agrees and acknowledges that they are lawfully competent to enter into all terms, conditions, obligations, representations and responsibilities set forth in the Terms of Use.
b. User-Generated Content. By posting messages, comments, uploading files, inputting data or engaging in any other form of communication to BSH’s Website or services (the “Website”), you hereby grant to BSH a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty free license to use, copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit or otherwise exploit such communications, in all media now known or hereafter developed.
BSH reserves the right to remove user-generated content it deems objectionable, at its sole discretion.
c. Content of the Website and Services. The contents of the Website are intended for your personal, non-commercial use. All materials published or available on the Website (including, but not limited to text, photographs, images, illustrations, designs, audio clips, video clips, “look and feel,” metadata, data, or compilations, all also known as the Content (“Content”) are protected by copyright and owned or controlled by BSH as the provider of the Content. BSH also owns copyright in the selection, coordination, compilation, and enhancement of such Content (“Arrangement”). You must abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Website. Non-commercial use does not include the use of Content without prior written consent from BSH in connection with: (1) the development of any software program, model, algorithm, or other generative AI tool, including, but not limited to, training or using the Content in connection with the development or operation of a machine learning or artificial intelligence (AI) system (including any use of the Content for training, fine tuning, or grounding the machine learning or AI system or as part of retrieval-augmented generation); or (2) providing archived or cached data sets containing Content to another person or entity.
The Website and Content are protected by copyrights, trademarks, trade secrets, database rights, sui generis rights and other intellectual or proprietary rights in or to the Content pursuant to U.S. and international laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create new works from, distribute, publicly perform, display, communicate to the public or in any way exploit any of the Content (or its Arrangement) or the Website in whole or in part.
You may download or copy any downloadable Content and other downloadable items displayed on the Website for your personal use only, provided that you maintain all copyright and other notices contained in the Content and other downloadable items. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from BSH.
d. Means of Entry. Terms of Use are applicable to all means of entry to the Website and Content of BSH.
e. Age Limit. Users must be 18 years of age or older to use the Website.
f. Privacy Policy. BSH and User agree to abide by BSH’s Privacy Policy (“Privacy Policy”).
g. Governing Law and Forum. This Agreement shall be governed by and construed in accordance with the laws of the state of Colorado without regard to conflicts of law provisions. Sole and exclusive jurisdiction for any action or proceeding arising out of or related to this Agreement shall be a Colorado state court located in Douglas County, Colorado.
h. Limitations of Liability. BSH shall not be liable for the use of the Website, including, without limitation, Content and any errors contained within. BSH shall not be liable for the opinions, allegations, or factual recollections of individuals interviewed in connection with Content.
i. Revision Date. From time to time, BSH at its discretion may revise, update or alter its Terms of Use or Privacy Policy. User agrees to periodically check the Revision Date and confirm agreement to revised Terms of Use.
